WILZIG COURT RULING STILL PENDING

A decision on the fate of Alan Wilzig’s proposed sporting course/racetrack in Taghkanic is still in the offing, months after legal challenges were filed with the courts.
Officials with The Granger Group, which has mounted a vigorous campaign against the project, said there has been no decision from New York State Supreme Court Justice Patrick J. McGrath on the legal challenges to the track/course. Three separate lawsuits have been filed to stop Wilzig from developing the track/course on his Post Hill Road property. The suits have been combined into one.
Warren Replansky, attorney for The Granger Group, told ccSCOOP that Judge McGrath has not issued a ruling yet, but added that the judge has to review a “quite voluminous" document before making a decision. "There's a lot of paperwork that he must review," said Replansky.
Diane Rodriguez, a member of The Granger Group, said that a ruling had been anticipated in mid-November.
The Granger Group seeks to overturn town decisions that are allowing Wilzig to construct a 40-foot-wide, mile-long paved “sporting course” on his compound. Opponents have labeled the development a racetrack and allege that Wilzig could hold motorcycle races and professional events there. Wilzig and his supporters contend the paved track will be nothing more than a sporting course where Wilzig can ride his Ducati motorcycles and his children can ride their bikes.

In April, the Town Planning Board gave conditional approval to the track/course. In June, the Zoning Board of Appeals determined the development was a “recreational use” allowed under the town's zoning regulations.
